2. Services
Garcia Media Co. offers the following services, subject to a separate written agreement:
- Digital marketing strategy and management
- Website design and development
- Monthly retainer services
- Annual website hosting and maintenance
- SMS and email marketing campaigns
All service scopes, deliverables, timelines, and fees are defined in your individual service agreement or proposal.
3. Payment Terms
Payment is processed securely through Stripe. By providing payment information, you authorize Garcia Media Co. to charge you for agreed services. For recurring services, charges will be applied automatically on the billing cycle specified in your agreement.
- All fees are in USD unless otherwise stated
- Invoices are due upon receipt unless stated otherwise
- Late payments may result in service suspension
- Refunds are handled on a case-by-case basis per your service agreement
4. SMS Communications
By providing your phone number through our website or chat widget, you may opt in to receive SMS messages from Garcia Media Co. These may include appointment reminders, project updates, and promotional offers.
We do not share your phone number with third parties for marketing purposes.
5. Intellectual Property
Upon full payment, clients receive full ownership of final deliverables created specifically for them, including website designs and marketing materials. Garcia Media Co. retains the right to display completed work in our portfolio unless otherwise agreed in writing.
All proprietary tools, systems, templates, and processes used to deliver services remain the intellectual property of Xander Systems LLC.
6. Confidentiality
We treat all client information as confidential. We will not disclose your business information, strategies, or data to third parties without your explicit consent, except as required by law.
7. Limitation of Liability
Garcia Media Co. shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability for any claim shall not exceed the amount paid by the client in the 30 days preceding the claim.
8. Termination
Either party may terminate services with written notice as specified in the service agreement. Upon termination, all outstanding balances become immediately due. Garcia Media Co. reserves the right to terminate service for violation of these terms.
9. Governing Law
These terms shall be governed by the laws of the State of Wyoming. Any disputes shall be resolved through binding arbitration in Cheyenne, Wyoming.
10. Changes to These Terms
We may update these Terms of Service from time to time. Continued use of our services after changes constitutes acceptance of the updated terms. We will notify active clients of material changes via email.
